Pasal 49 ayat 1 berbunyi : barang siapa terpaksa melakukan perbuatan untuk pembelaan karena ada serangan atau ancaman serangan ketika itu melawan hukum terhadap diri sendiri maupun orang lain terhadap kejormatan kesusilaan (eerbaarheid) atau harta benda sendiri maupun orang lain, tidak dipidana.

Daya Paksa ( overmacht)
Pasal 48 berbunyi: barang siapa melakukan perbuatan karena terpengaruh daya paksa ridak dipidana. Kata DAYA PAKSA ini adalah salinan kata Belanda OVERMACHT, yang artinya kekuatan atau daya yang lebih besar.
